I think it varies state to state.
Kentucky requires a permit to keep any native species

Like Algenco said, it varies between states. Check with your local Wildlife and Fish Department to make sure, it won't be expensive if it is needed and it's better safe than sorry!

What state are you in?

Most states will have no problem with keeping Madtoms, but Darters can get complicated. There are several species of Darter that are protected and others that are very abundant...it will likely come down to the individual species with them.
