This is not cool.... I rent through a property manager that told me I could get a 125 gallon no problem. My landlord just stopped in unexpectingly from Florida. He is here visiting family. I let him in the house and he seen all the tanks.... His first reply was I don't mind these 55 gallons but nothing bigger okay. Oh my god stop.... I argued for 20 minutes to no end.... We went over the lease I signed. Under pets it says at owners discretion (not the property manager). I can't get a 75 gallon or a 125 now... What the heck am I going to do with my Oscars and GT.... I can get 2 Oscars in a 55 gallon. I really don't want to but I could. That leaves the GT and firemouth with no home...
My wife is dead set on the planted 55 gallon. That was our agreement to get the stuff I did last night..... This sucks..... sigh....

Wow J-Man, that sucks. I hate it when people go back on their word... It seems like alot of people are having problems with their landlords... First Karbomb, now you. Mine sucks as well. We live in an older house, and he refuses to fix anything. The water heater crapped the bed before I moved in. The landlord got a new one after like 2 weeks, but just left it there, and Cara's dad had to come put it in. One of the water pipes that come in from outside is in our tank room, and an exposed pipe. It started to leake (luckily when it was just an empty room) and he did nothing about it. Again, Cara's dad had to come over late one night to fix it. The faucet leaked... he just bought us another one, I had to put it in. It's getting really old. We don't have a lease though, so I think we're just gonna up and leave soon.

I'm sorry man. So the owner limits you to 55g. Does he limits you to the # of 55g you can have?

Under pets it says at owners discretion (not the property manager)

So what's the problem?

Shove that Lease Agreement down his throat!!!

No I could get another but I really don't want to keep green terrors and Oscars in a 55 gallon... I guess I may try to find yet another 55 gallon. Run the 2 Oscars in one, get rid of the Firemouth, get another GT so that one has a tank mate and put those 2 in the other 55 gallon.... Hmm.....

Oh crap my tree root........ Oh that is even worse.... I got 20 hours of work into that thing.... It is 14 inches thick.... This is spiraling down the crapper as we speak..... Ah I'm so frustrated..... It won't fit in a 55 gallon..... I will have to cut that now to.... Dang it.....

So what's the problem?

Shove that Lease Agreement down his throat!!!

In the state of Maryland a tenant is responsible to cover the remaining monthly rent until the lease has expired if they brek the lease.... The lease doesn't expire until December 2008.... I got 9 more months... Thats 7200 dollars I'd owe him.....

I truly sympathise ... my landlord won't less us have more than a 10g, and we had to twist her arm to let us get a second tank (the 5g).

Wow that is worse than me. I'm just frustrated because I had permission from the property manager and that is the only reason I got the Green Terror. I can't get rid of the Green Terror. That is my daughters favorite fish..... All the fish could leave and as long as that one stayed she would be happy..... sigh........this is frustrating....

I am sorry to hear about you problems Jaime, I know exactly where you are coming from, we had a landlord who would not let us have any tanks years ago. We now have our own house and not being able to have tanks for so long, our house is now over run with them, will have to move soon, if this keeps up. I do feel very bad for you, nothing worse than being told you can't do something, when someone already told you that you could. SORRY!!!

rent until the lease has expired if they break the lease.

?? You're not breaking the lease, though, that's my point...

Or am I not getting something?

it's at the discretion of someone though...doesn't matter who really...and yes it may have said pets are allowed but you have to remember the weight invovled in large tanks and that the building may not be designed with those types of loads in mind espcially if you are on an upper floor or if the floor is not concrete on ground. the reason for it is more than likely not that he hates you but rather a structural integrity and safety issue.

why not get a 75g?? they are the same length, height basically as a 55g. You could keep 2 oscars in the 75 and the gt in one 55 with the other fish...

Get the 125 anyways and don't let him in again. Whats the worst that can happen?? You'd have to move??:wink2:

I'll just be up front about this. If you want him to dissapear , I can make it look like an accident. :wink2:

If there is nothing in the lease agreement forbidding you to get the larger tank, get it, and when he complains, tell him to point out where it says you can't get a larger tank. I don't think he can amend a signed lease without you signing as well, so just don't sign to it.

I can't violate my lease..... I have a 2 year old daughter that depends on me... If I was single I'd go for it for sure but I have to be responsible and support my wife and daughter... I will probably set another 55 gallon to move the GT into, keep the two Oscars in the 55 gallon, and get rid of the firemouth.... The landlord is from Florida but the propery managers are local. In the lease they can inspect my house at anytime with 48 hours notice.... I'm sure I'll see them a couple times in the near future.....

I just read through the Maryland lease laws and they are almost Identical to the state where I live.

"A lease obligates you to pay rent through the end of the lease. If you break your lease, the landlord can hold you responsible for the rent due through the remainder of the lease. However, a landlord is required to make a reasonable effort to re-rent the apartment to limit losses. If the landlord is able to re-rent the unit, you are only responsible for the rent until the date the new tenant moves in. However, a landlord with multiple vacant units is not required to put a new tenant into the unit you have vacated. Also, a landlord can hold you responsible for costs of re-renting, such as advertising for a new tenant. "

You would not be responsible for the entire 9 months, only the time it took the landlord to re-lease the property, and by law, the landlord must make every effort to re-lease the property to a new tennant as quickly as possible. Althoush it seems that if he wanted to he could be a real pain in the rear, and fill other vacancies first.

What your landlord is putting you through sucks. If your lease agreement allows you to put a waterbed in your apartment, the floor should hold a 125 gal. aquarium. You may be required to have a rider put on your renters insurance policy to cover damages should an aquarium break. This is usually about 10 to 15 dollars a year depending on where you live.

If it were up to me, I would look at the vacancy rate, and base my decision on that. I would try to move into a place where the property manager or landlord would not go back on his word, or buy a house.

Link to Maryland's Tennant-Landlord laws site:[Only Registered Users Can See Links.]

However, I am not an attorney. Please check with one and don't base any decisions on what I say! I am just telling you what I might do if I were in your situation. I would probably just set up the big tank and let it fall through the floor.....

Hope this helps, and sorry to be so long winded....And good luck.....

The property management division that rents my house rents over 200 houses in the surrounding areas.... This house was vacant for 13 months before I moved in... In this city the rents are high for the wages that are made. Alot of people can't afford this rental because it is 800 a month plus all utilities... Ends up being around 1200 a month for all the bills. I can't pickup and go it would be irresponsible on my part. I have to provide for my family.... The Oscars are going to have to wait until December until I buy my own house..... Thank you all guys for the help. I really appreciate it.... I feel bad for the fish but I can't drag my family into a hole over a fish.... The Oscars will be fine until December. They are still relatively small..... The firemouth is going back to the petstore tomorrow. I talked one of my friends who owns a lfs into taking him....

Oh the actual owner never said I could have the 125 gallon. The property managers did. I assumed they had permission from the owner.....

Its probably for the best that you are taking the responsible path by thinking family first. You have just made me never want to rent a house/apartment, which is a good thing. In the end this will work out for you, just have to be patient.

yeah, thank god i dont live in a apartment, i would think as long as you even got a engineer to check if the flooring could hold the weight it should be fine

however, in general most landlords allow usually 75g max, some will okay a 90g. If it were me i would get the 125g and not mention anything, bet $10,000 he doesnt know tank sizes. however its not work risking your family

I actuall live in a full house.. The problem with the houses here like I was telling Sailor is they are old. Really old.... George Washingtons revolutionary war headquarters was here... Some of the houses are mid 18th century and still standing. This one was probably built early 1900's.. The landlord is a 60 year old guy. He has already had a 150 go through the floor on the other side of the house lol..... I'm not frustrated he said no... I'm frustrated the property managers said yes... If they would have said no I would have left the two Oscars in the 55 gallon and not gotten the GT.... Oh well..... I might just talk my wife into another GT and scrub the entire cardinal tetra/bolivian tank... My wife would be so mad at me though.....

I haven't seen your project since you first started working on it,, but it sounds awesome. How big is it? Instead of cutting it, try selling it. I have a 280gal goin up soon, maybe I'll be interested?

Heres the thread Civic.. I haven't done anything with it for days. I will probably cut off the front branches.... If I can get it from 14 inches down to 11 I can squeeze it in the tank.....

Height is good as it will fit in the 55 gallon. I will have to cut the 2 right downbraches back in 3 inches to get it to fit.... Man that is like a double punch to the gut lol... No tank plus a diy project with over 20 hours in is no good.....
